Company Liability Waiver & Acknowledgment

This Liability Waiver and Acknowledgment (“Agreement”) is entered into by and between Gulley Hurst, LLC (“Landfill”) and your company name listed below as (“Company”).

1. Assumption of Risk

The Company acknowledges that entry onto Landfill property by its employees, drivers, contractors, or agents (collectively “Drivers”) involves inherent risks, including but not limited to: movement of heavy equipment, dumping activities, uneven surfaces, and other industrial operations.

2. Compliance with Rules & Safety Procedures

The Company agrees that all Drivers must:

  • Comply with all posted rules, safety instructions, and directions provided by Landfill staff.

  • Maintain their vehicles and ensure they are properly…

  • Operate vehicles in a safe and lawful manner at all times.

  • Wear all required personal protective equipment (PPE) while on Landfill property.

Failure of any Driver or Employee to follow these rules shall be the sole responsibility of the Company.

3. Insurance Requirement

The Company certifies that it maintains current and valid full coverage insurance (including general liability, vehicle liability, and workers’ compensation, where applicable) for all vehicles, equipment, and personnel entering Landfill property. Proof of such insurance must be provided to the Landfill upon request. Entry onto Landfill property without adequate insurance coverage is strictly prohibited. It is company’s responsibility to notify Landfill if insurance changes or is renewed or cancelled.

4. Release of Liability

To the fullest extent permitted by law, the Company releases and holds harmless the Landfill, its owners, officers, employees, and agents from any and all claims, damages, injuries, losses, or liabilities that may arise from:

  • The Company’s or its Drivers’ actions, negligence, or failure to follow rules.

  • Accidents or incidents involving Company vehicles, equipment, or personnel on Landfill property.

5. Indemnification

The Company agrees to indemnify and defend the Landfill against any claims, demands, or lawsuits arising from the actions, negligence, or misconduct of its Drivers while on Landfill property.

6. Acknowledgment of Responsibility

The Company understands and agrees that it is fully responsible for the conduct of its Drivers while on Landfill property, including any damage caused to persons, property, or equipment.

7. Binding Effect

This Agreement shall be binding upon the Company, its officers, employees, agents, insurers, and successors.
