WAIVER AND RELEASE OF LIABILITY
This Waiver and Release of Liability (the "Waiver") is made effective as of the date signed below by the customer ("Customer"). WHEREAS, the Customer wishes to enter onto the property of Gulley Hurst Landfill, Gulley Hurst, LLC (collectively, the "Company") for the purpose of utilizing its services.
NOW, THEREFORE, in consideration of being permitted to enter onto the Company’s property, the Customer agrees as follows:
Insurance Requirement: The Customer shall maintain their own insurance coverage and provide proof of such coverage to the Company prior to entry onto the property. The Customer agrees to update the Company with a copy of their insurance policy whenever changes occur.
Release of Liability: The Customer, along with any drivers or agents acting on their behalf, hereby releases, waives, and forever discharges Gulley Hurst Landfill, Gulley Hurst LLC, its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action whatsoever, arising out of or related to any loss, damages, or injuries (including death) that may result from the Customer’s participation in activities on the Company’s property, including but not limited to the loading or unloading of debris or any vehicle assistance provided by landfill staff and operators.
Assumption of Risk: The Customer acknowledges that the activities associated with the use of the Company’s property involve risks and dangers, including but not limited to the risk of property damage, personal injury, or death. The Customer voluntarily assumes all risks associated with their activities on the property.
Customer Requirements: The Customer understands and agrees to the following:
The Customer must remain in their vehicle at all times, except when necessary to remove or open their vehicle for unloading.
The Customer is not permitted to walk away from their vehicle at any time.
No scavenging or removal of materials from the property is allowed.
No smoking, No vaping and No flames
No cell phones can be used on property
Abide by speed limit signs on property
Governing Law: This Waiver shall be governed by and construed in accordance with the laws in Texas, in which the Company operates.
